1. Agreement
These Terms of Use (“Terms”) govern your use of the Groggy iOS app and the website at getgroggy.com (together, the “Service”). By downloading, accessing, or using Groggy, you agree to these Terms and to our Privacy Policy.
The Service is operated by Till Theurer, sole trader (Einzelunternehmen), Carl-Friedrich-Straße 7, 76437 Rastatt, Germany.
2. The service
Groggy helps you start the day with a simple commitment loop:
- Selected apps can stay shielded overnight using Apple’s Screen Time APIs
- In the morning you complete tasks you configured (for example make the bed)
- Each task is proven with a live camera photo checked by an automated vision check
- When tasks are done, the shield lifts for that day
Groggy is a productivity and habit tool. Features may change as we improve the app. Availability depends on Apple platforms and permissions you grant.
3. Subscriptions and paywall
Core blocking features require a paid subscription. Groggy uses a hard paywall in onboarding: you need an active subscription to finish setup and use locking features. There is no free full-access path in the current product.
3.1 Plans
Subscription options may include weekly, yearly, and founding yearly plans
(App Store product IDs such as groggy_weekly, groggy_yearly,
and groggy_founding_yearly). Prices are shown in the App Store / in-app purchase
sheet in your local currency and may vary by region.
3.2 Apple billing
- Payment is charged to your Apple ID.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
- After you cancel, you keep access until the end of the paid period.
- Manage or cancel in iOS Settings → Apple ID → Subscriptions, or via apps.apple.com/account/subscriptions.
- Refund requests for App Store purchases are handled by Apple (reportaproblem.apple.com).
3.3 No lock without access
If your subscription is not active, Groggy must not keep your apps locked. Access status is checked so an expired plan does not leave you blocked.
4. Blocking, pauses, and fail-open
You choose what to shield and when the night lock starts. You can pause or end a lock using the in-app friction path (a short wait, then pause options or end for today). Pause limits may apply. Ending the lock for today may affect streak credit.
Fail-open is a product rule: a technical failure on our side must not trap you. Examples: if the verify server fails while you have internet, a live photo can still count; after two failed photo checks, Groggy may grant a courtesy pass for that task; missing subscription access means blocking stays off. Circumventing the shield outside these paths (for example by deleting the app) is possible by design. Groggy is a commitment aid, not a prison.
Offline: no internet is not an automatic unlock. Reconnect to verify, or use the intentional pause / end path.
5. Photos and verification
Task proofs use the live camera only (no photo library picker for verification). Images are sent to our verify Worker for a one-time automated check and are not stored by us after the check. Automated checks can be wrong. Retry and courtesy rules exist to reduce frustration. You are responsible for what you photograph.
6. Not medical or professional advice
Groggy is not a medical device and does not provide medical, mental health, sleep therapy, or other professional advice. It does not diagnose, treat, or cure any condition. If you have concerns about sleep, mood, or health, talk to a qualified professional. Use of the app is at your own discretion.
7. Acceptable use
You agree not to:
- Use the Service for unlawful purposes
- Abuse, overload, or attack the verify endpoint or related infrastructure
- Attempt to reverse engineer the app except where local law allows
- Misrepresent automated verification results in a way that harms others
- Use the Service if you are below the age minimum in section 8
8. Eligibility
You must be at least 17 years old to use Groggy. If you are under the age of majority where you live, you need a parent or guardian’s permission to use the Service and to purchase a subscription.
9. Intellectual property
Groggy, the Groggy mascot, and related branding and software are owned by the operator or its licensors. These Terms do not transfer ownership to you. You get a limited, personal, non-exclusive license to use the app as provided through the App Store.
10. Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that blocking, notifications, streaks, or AI photo checks will be uninterrupted, accurate, or error-free. Apple’s system APIs and your device settings can affect behavior.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. THIS INCLUDES CONSEQUENCES OF APPS BEING BLOCKED OR UNBLOCKED, MISSED MESSAGES WHILE APPS ARE SHIELDED, OR INCORRECT PHOTO CHECKS.
Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for Groggy subscriptions in the 12 months before the claim, or (b) EUR 50, except where liability cannot be limited under applicable law (for example death or personal injury caused by negligence, or fraud).
12. Changes and termination
We may update these Terms or change the Service. For material changes we will update the date above and provide reasonable notice when practical. Continued use after changes means you accept the updated Terms, unless applicable law requires otherwise.
You may stop using Groggy at any time and cancel your subscription through Apple. We may suspend or stop offering parts of the Service. If we discontinue the app, subscription refunds remain subject to Apple’s rules.
13. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules, except that mandatory consumer protections in your country of residence still apply. Courts in Rastatt, Germany, have jurisdiction, subject to mandatory consumer venue rights.
